Q: What power does the "planning authority"have by not setting up formal rules?
A: Formal rules are made in advance so that the actions of the state in any instance can be forseen by the individual depending on the time and place of their actions (80-81). The "planning authority" cannot uphold such rules because if they are to guide people towards one common goal, they must be an "arbitrary government" and therefore if they did first lay down rules to be known ahead of time, it would not be able to weild the power they want over their citizens. This also leaves an out for them to be discriminatory to certain groups or peoples simply because they must make up rules as they go, and therefore choose someone's views over another's in a dispute (82).
